Terms and conditions
Last updated 12 October 2026This is a translation. The German version is the binding one.
1. Scope
These terms govern the use of Wohnprobe (wohnprobe.at), run by Werkmind OG, Am Rechen 19, 3380 Pöchlarn (“we”). They apply to all users, in particular estate agents and businesses with an account. A user’s own terms apply only if we agree to them in writing.
2. The service
Wohnprobe makes reports on addresses and areas in Austria: transport, shops, education, health, green space, internet, environment, natural hazards and housing costs. The reports are built on third-party data, mostly from public bodies, as at the date shown. We keep developing features and data sources and may change, add or discontinue them. We aim for high availability but don’t promise any particular level.
3. Account and access
- Full reports need an account. It is tied to the email address you pay with and is made with your first purchase.
- An account is personal. Keep sign-in links secret and don’t pass them on.
- Your details (name, agency, contact, logo) must be correct. Keep them up to date.
- How many full reports your account holds follows from your purchases. A report unlocks the full report for one place for good; you can change the radius and mode of travel there at any time.
4. Prices and purchase
- The preview of a report, with the area score, is free.
- Full reports come in packs, at the prices shown before you buy. A pack is a one-time purchase, not a subscription.
- A report you bought stays in your account for good. Unused reports in a pack never expire.
- You pay online through Stripe when you buy. The invoice comes by email.
- Consumers: Wohnprobe delivers digital content at once. By buying, you expressly agree that we start before the withdrawal period ends, and acknowledge that you lose your right of withdrawal (§ 18(1)(11) of the Austrian Distance and Off-Premises Contracts Act, FAGG).
5. Using the reports
- Reports from private packs are for your personal use. Using reports professionally, such as handing them to clients or putting them in listings, needs an estate agent account.
- With an estate agent account you may use reports and PDFs with your clients and prospects, for example in listings and meetings.
- The source credits in a report stay in place. The data licences require them.
- Don’t present a report as an expert opinion, a property valuation or your own survey.
- Automated retrieval of reports or data, reselling reports or data as a data product of your own, and anything that disrupts Wohnprobe are not allowed.
6. Your content
You are responsible for your logo and details: you hold the rights to them and they infringe no third-party rights. You allow us to store them and show them in your reports while your account exists. The name and note you write into a PDF for a client stay in your browser; you are responsible for how you use them.
7. No advice
A report compares places on measured data. It is not a property valuation, an expert opinion, or legal, tax or financial advice, and it doesn’t replace a viewing. Check what matters to a decision before you or your clients commit.
8. Liability
- The data comes from third parties and reflects the date shown. To the extent the law allows, we give no warranty for its accuracy, completeness or currency.
- We are liable for intent and gross negligence. We are not liable for slight negligence, except for personal injury.
- Towards businesses, we are not liable for lost profit, consequential loss or pure economic loss, except in cases of intent.
- Mandatory consumer rights under the Austrian Consumer Protection Act remain unaffected.
9. Data protection
How we process personal data is set out in the privacy policy.
10. Term and termination
You can close your account at any time by emailing hello@wohnprobe.at. We can close an account with 14 days’ notice by email, or immediately if these terms are breached. After that we delete your account data as described in the privacy policy.
11. Changes
If we change these terms, we email account holders the new version at least four weeks in advance. If you don’t object before it takes effect, the new version applies; the email will say so. If you object, either side may close the account.
12. Law and jurisdiction
Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods and conflict-of-law rules. For businesses, the courts with subject-matter jurisdiction for Pöchlarn have jurisdiction. Consumers keep their mandatory statutory venues. If a provision is invalid, the others remain in force.
